Terms & Conditions

These terms are the agreement between you and kenikon covering your use of the Super Block Puzzle Android game. By installing or playing the game you accept them. If you do not accept them, uninstall the game.

In plain terms. The game is free. You may play it on your own devices but not copy, resell or reverse engineer it. It is funded by adverts. Coins earned in the game have no real-world value. We provide the game as it is and will not be liable for indirect losses, but nothing here removes rights the law gives you as a consumer.

Who you are contracting with

The game is published by kenikon, based in Baku, Azerbaijan, contactable at [email protected]. In these terms "we" and "us" mean kenikon; "you" means the person using the game; "the game" means the Super Block Puzzle Android application and its updates.

Age requirement

You must be at least 16 years old to use the game. If the age of digital consent where you live is higher than 16, that higher age applies. If you are below that age, a parent or legal guardian must accept these terms on your behalf and supervise your use of the game.

Your licence to play

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and play the game on devices you own or control, for your own private entertainment. The game is licensed to you, not sold.

You may not, except where the law expressly permits it despite this clause:

Our intellectual property

All rights in the game — including its code, artwork, sound, level design, name, logo and branding — belong to us or to our licensors and remain with them. Certain underlying components are licensed to us by third parties, including the game engine and the template the game was built on; those rights remain with their owners. These terms grant you no right to use our name, logo or branding for any purpose.

Acceptable use

The game has no chat, no player profiles and no way to upload or share content, so there is little scope for misuse. You still agree not to use the game to break the law, not to use cheats, modified clients, emulated input or automation to manipulate scores or generate fraudulent advert impressions, and not to interfere with other players' devices or with our systems.

Coins and virtual items

The game includes coins and other virtual items that you earn by playing, through the daily bonus, or through the Lucky Spin. These items:

The game currently offers no in-app purchases. If purchases are added in future, we will publish updated terms covering payment, refunds and your statutory right of withdrawal before the feature is enabled.

The Lucky Spin awards randomised rewards but costs only coins earned inside the game. No real money can be spent on it.

Adverts

The game is free because it is funded by advertising. It shows banner adverts during play and occasional full-screen adverts between rounds, delivered by Google AdMob. We choose the placement and frequency of advert slots, but we do not choose which individual adverts appear and we are not responsible for their content or for any product or service they promote. If an advert appears to breach Google's policies, report it through the in-advert controls or tell us and we will pass it on.

Your data

How the game handles data is set out in our Privacy Policy, which forms part of these terms. In short: there is no account, we collect no personal data ourselves, and the advertising SDK receives technical identifiers from your device in order to serve adverts. You control whether those adverts are personalised.

Keeping your own device secure is your responsibility. We advise against rooting your device or installing the game from anywhere other than Google Play, as modified builds may not work correctly and may not be safe.

Connectivity and device costs

The game plays offline, but adverts need an internet connection. Any data charges, roaming charges or other costs your mobile operator applies are yours to pay, and your agreement with them continues to apply. If you are not the bill payer for the device, we assume you have their permission to use data on it. We are not responsible for the game being unavailable because of a lost connection, an exhausted data allowance or a discharged battery.

Updates and availability

We may release updates that fix problems, change the game's content or balance, or maintain compatibility with new versions of Android. Some updates are necessary to keep the game working, and Google Play may install them automatically depending on your settings. We do not promise to keep supporting older versions of Android or older versions of the game.

We may also change the game's features, or stop publishing it, at any time. If we stop publishing it, you may continue to use any copy already installed for as long as it works on your device, but we will not be obliged to provide updates or support.

Ending this agreement

You may end this agreement at any time by uninstalling the game.

We may end it if you materially breach these terms. Where the breach can be fixed and no immediate harm is being done, we will tell you what the problem is and give you 14 days to fix it before ending the agreement. We may act immediately where you are breaking the law, infringing intellectual property rights, committing advert fraud, or doing something that risks harm to other users or to us. When this agreement ends, your licence ends and you must delete the game from your devices.

No warranty

The game is provided as it is and as available. We do not promise that it will be uninterrupted, error-free, free of bugs, or compatible with every device or Android version. To the extent the law allows, we exclude all implied warranties. Statutory guarantees that consumer law gives you, including the requirement that digital content conform to its description, are not affected by this clause.

Limitation of liability

We remain fully liable for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, and for anything else that cannot lawfully be excluded or limited.

Subject to that, and to the extent the law allows: we are not liable for indirect, incidental, special or consequential loss, including lost profits, lost data or business interruption; and our total liability for any claim relating to the game is limited to the greater of the amount you have paid us for the game in the 12 months before the claim, or the minimum amount the applicable law requires. The game is free, so in most cases this means our liability is limited to the minimum permitted by the law that applies to you.

We are not liable for the content of third-party adverts, or for loss you suffer by relying on information supplied by a third party through the game.

You are responsible for loss we suffer that is caused by your deliberate misuse of the game or your breach of these terms, but not for anything caused by our own negligence, our breach of these terms, or our failure to comply with the law. Where consumer law restricts this kind of clause, it applies only to the extent that law permits.

Nothing in these terms limits any right you have under consumer protection law that cannot lawfully be excluded.

Google Play

The game is distributed through Google Play, and Google Play's own terms of service apply to your download alongside these terms. Google is not a party to this agreement, is not responsible for the game, and provides no warranty for it. If the two sets of terms conflict on a point Google governs, such as refunds for store transactions, Google's terms take precedence for that point.

Governing law

These terms are governed by the laws of the Republic of Azerbaijan, excluding its conflict of law rules. Disputes may be brought before the courts of Azerbaijan.

If you are a consumer resident in the European Union, the United Kingdom or another country whose law gives you mandatory protections, this clause does not deprive you of them: you keep the benefit of the consumer protection rules of your country of residence and may bring proceedings in the courts there.

General

Severability. If a court finds any provision invalid or unenforceable, that provision is reduced to the minimum extent needed to make it enforceable, or removed if that is not possible, and the rest of these terms continue to apply.

Entire agreement. These terms and the Privacy Policy are the whole agreement between us about the game and replace any earlier understanding.

No waiver. If we do not enforce a provision immediately, we do not lose the right to enforce it later.

Changes. We may update these terms. The new version will be published here with a new effective date and version number, and where the change is material we will make it visible in the game before it takes effect. Continuing to play after that means you accept the new version. Earlier versions are available on request. If you do not accept a change, uninstall the game.
